Clave Service Agreement

These Terms of Service govern your use of the Clave subscription service provided by ExVulcano. By subscribing to Clave, you agree to these terms.

1. Service Description

ExVulcano provides a subscription-based web service called "Clave", which includes the creation, hosting, and maintenance of a static website composed initially of three pages (e.g. Home, About, Contact). The site is generated using a proprietary system and is entirely managed by ExVulcano.

The service is provided in "software-as-a-service" (SaaS) mode: the client receives a complete website without having to manage technical infrastructure or maintenance.

2. Activation and Payment

Monthly Payment

Each monthly payment includes: Website creation based on the information provided by the client, Hosting and infrastructure management, Domain registration (unless a domain is already owned by the client)

Pricing

The price is €49/month (taxes included or excluded based on VAT rules in effect).

3. Domain and Hosting

If the client does not already own a domain, ExVulcano will register one on their behalf. The domain will be managed under ExVulcano's infrastructure to ensure full compatibility with the proprietary system.

The site must be hosted on ExVulcano-managed servers. It is not possible to export or transfer the site to another provider.

4. Ownership and Intellectual Property

The website, its code, and the underlying platform are the exclusive property of ExVulcano.

The client is granted a non-transferable, non-exclusive, revocable license to use the website as long as the subscription remains active.

In the future, clients may have the option to permanently acquire the website by paying a one-time fee equal to 24 monthly installments, i.e., two years of service. This option is not currently available.

5. Cancellation

The client can cancel the subscription at any time by sending an email to info@exvulcano.com or via another method provided on the ExVulcano website.

The cancellation becomes effective at the end of the current billing period. No refunds are issued for partial months or for months already paid.

Upon cancellation, the site will be taken offline and the license to use the website will be revoked.

6. Responsibilities and Content

Clients are responsible for the content they provide, including texts, images, and logos.

ExVulcano assumes no responsibility for copyright infringement or illegal material uploaded or sent by the client.

The client agrees to provide only content they are legally authorized to use.

7. Changes to Terms

ExVulcano reserves the right to modify these Terms of Service at any time. Updates will be published on the official website and will be effective immediately.

Continued use of the service implies acceptance of the updated terms.

8. Jurisdiction

If the client is a consumer, any disputes will fall under the jurisdiction of their place of residence.

For all other cases, the competent court will be that of Bari, Italy.
